SUNFISH LAKE PLANNING COMMISSIONMEETING – March 20, 2019

1. CALL TO ORDER: Chair Hendrickson called the meeting to order at 7:05 p.m.

2. ADOPT AGENDA: Chair Hendrickson asked if there were any additions to the agenda and there was no response.

Commissioner Nelson moved to adopt the agenda, seconded by Commissioner Nayes and carried (4-0)

3. APPROVE MINUTES: Chair Hendrickson noted that the previous minutes were approved 4-0 not 3-0.

Chair Hendrickson asked if there were any other additions or corrections to the Minutes.

Commissioner Nayes noted that on page 2, the 5th paragraph it looks like an additional sentence was started, we can just remove that sentence after “…properties that are 2 acres”

Commissioner Driano moved to approve the February 20, 2019 minutes as corrected, seconded by Commissioner Nayes and carried. (4-0)

At this time, Chair Hendrickson asked Commissioner Nelson to recuse herself from her position as a Commissioner and take a seat in the audience. Commissioner Nelson agreed.

4. PUBLIC HEARING: 357 Salem Church Road – Major Site and Building Plan and Conditional Use Permit.

Planner Grittman gave his report and stated that there are two items to consider, the major site and building plan review for the home addition that exceeds 1,000 square feet; and the conditional use permit to add a swimming pool as a third accessory structure. He stated that the property is zoned R-1 Single-Family and is in the Shoreland Overlay District of Sunfish Lake. He stated that the lot is a legal conforming lot of record with 3.98 acres of buildable space approximately. The project meets all setback requirements, building height limitations, and site coverage limits for the R-1 District and the Shoreland Overlay District.

Planner Grittman stated that the metal roofing material is not specifically permitted by the zoning ordinance so the City Council will have to make a final decision on whether or not to approve the metal material.

Planner Grittman stated that the City Engineer has reviewed the plan and is recommending approval of the site’s grading, drainage, and stormwater management plan. Grittman stated that a rain garden has been added to the plan on the north side of the site to collect rainwater runoff from the hard surface areas.

Planner Grittman stated that the Zoning ordinance has seven criteria to review when considering a conditional use permit. Staff feels that the application does not impact any of the review criteria.

Planner Grittman stated that Staff is recommending approval of the application with the nine conditions of approval as outlined in his report dated March 13, 2019.

Commissioner Driano asked about the restoration plan.

Planner Grittman stated that condition number six addresses the restoration plan in both the report and findings of fact.

Chair Hendrickson thanked the Planner for his report.

Chair Hendrickson stated that he received a comment from the Johnsons at 349 Salem Church Road saying that they approve of the project and the plans that were presented.

Planner Grittman stated that he received an email from Emily Nguyen and Kevin Wu at 270 Salem Church Road have recommended approval of the project.

Dave Zweber of David Charles Designs said that he wanted to thank the Planner and his team, they were easy to work with and let them know of any issues that came up. Mr. Zweber stated that not all cities are that easy to work with.

Tom Schlehuber, 325 Salem Church Road stated that the pool and the project look great and asked how the pool is being drained with the chlorine in the water.

Dan Schmidt, the Civil Engineer for the applicant stated that he worked with the City Engineer and that the City Engineer requested that the water does not drain into the lake.

Chair Hendrickson stated that most pools are using a saltwater system and not a chlorine system. He also stated that most pools are not emptied in the winter in Minnesota because they’ll heave.

Mr. Schlehuber asked about the raingarden.

Chair Hendrickson stated there’s a raingarden as part of the project to collect runoff. He stated that the Engineer did condition that the pool cannot be drained into the lake.

Mr. Zweber stated that the homeowners purchased the property because of the architecture by Edwin Lundie. He stated that the applicants wanted the project to stay true to the architectural design of the original project. They’ve done everything they can to make the addition match the existing home which is not always the case with home additions.

Chair Hendrickson stated he has two concerns and is asking for two additional conditions:

  1. The septic area shall be enclosed and separated from the rest of the job site with silt fencing and / or erosion wattles.

  2. The stock pile area in the septic area be enclosed with a separate silt fence.

Chair Hendrickson made a motion to approve the site and building plans and the conditional use permit with the nine conditions of approval outlined in the Planner’s Report dated March 13, 2019 and the two additional conditions of approval as stated above. Motion seconded by Commissioner Nayes. Motion carries on a vote of 3-0

At this time, Commissioner Nelson was asked to join the Commission.


OTHER/NEW BUSINESS: Planner Grittman explained that there are several other projects in the works and we’ll most likely have a meeting next month and the month after in May.

Commissioner Driano moved to adjourn the meeting at 7:25 p.m., seconded by Commissioner Nayes and carried. (4-0)
