  1. CALL TO ORDER: Chair Hendrickson called the meeting to order at 7:00 p.m.
  2. ADOPT AGENDA:  Chair Hendrickson asked if there were any additions to the agenda and there was no response.

    Chair Hendrickson moved to adopt the agenda as presented, seconded by Commissioner Driano.  Motion carried (5-0) 

  3. APPROVE MINUTES, MAY 18, 2023, PLANNING COMMISSION MEETING: Chair Hendrickson asked if there were any additions or corrections to the May 18, 2023, Planning Commission meeting minutes.


Commissioner Nayes moved to approve the May 18, 2023, Planning Commission minutes seconded by Commissioner Beckett.  Motion carried. (5-0)

  1. PUBLIC HEARING: A. MINOR SITE AND BUILDING PLAN REVIEW AND VARIANCE APPLICATION, 2144 Charlton Road, applicant is Pat Mackey and the property owner is John Prange. Chair Hendrickson opened the meeting for the purpose of a public hearing on the application for a Minor Site and Building Plan Review and Variance for the property located at 2144 Charlton Road.  He reviewed the procedures for conducting a public hearing and asked the Planner to present her report.

Planner Johnson referred to her report dated June 15, 2023, as well as the presentation packet that was distributed this evening.  The property is zoned R-1 Single Family Residential and the land use is Rural Residential and located in the Shoreland Overlay.   She advised that the homeowner has submitted an application for a Minor Site and Building Plan Review and Variance approval.  The acreage of the site is 3.55.

The addition is less than 1,000 square feet and only requires a Minor Site Plan approval but are requesting a 30 feet – 1 inch Variance to the 50 foot side yard building setback. 

Existing Conditions

  • Existing two stall garage attached to the home
  • Existing garage setback to northeast property line approximately 33 feet 1 inch – requirement is 50 feet
  • The existing home does not meet the 200-foot setback to the OHWM required in the Shoreland Overlay, but is grandfathered in at this location
  • There is a well immediately west of the existing garage, as well as the septic field

PROPOSAL

  • New 389 square foot third stall addition
  • Existing driveway remains with small driveway addition to access the new third stall
  • New garage setback of 19 feet 11 inches (variance of 30 feet 1 inch)
  • Impervious Surface of 10.8% which meets code
  • Building Coverage of 4.1%
  • Only tree impacted could be a 30-inch oak tree adjacent to the garage but they are working with a tree care specialist to hopefully save the tree during the construction
  • DNR Area Hydrologist was notified with no comments

 

The Planner went over the Variance/Practice difficulty criteria and staff’s rationale for recommending approval.  The Planner stated that staff recommends approval of the Minor Site and Building Plan Approval and Variance subject to the Findings of Fact and with the five (5) conditions as listed in the Planner’s report both documents dated June 15, 2023.


Chair Hendrickson asked if there were any further comments from the applicant or public at this time. 

Chair Hendrickson asked if the Commissioners had any questions or comments. 

Chair Hendrickson asked about the proposed addition on the site plan.  The builder stated that this is just listed as an option for the homeowner.  There are no plans for any additions.

Chair Hendrickson asked if there were any further questions or comments and, hearing none, closed the public hearing.

Commissioner Driano moved to approve the Minor Site and Building Plan Approval and Variance located at 2144 Charlton Road by owner John Prange, based on the Findings of Fact dated June 15, 2023, and subject to the five (5) conditions listed in the Planner’s report dated June 15, 2023.

 Seconded by Commissioner Hendrickson and Motion carried. (5-0)

Chair Hendrickson moved to adjourn the meeting at 7:12 p.m., seconded by Commissioner Nayes.  Motion carried. (5-0)
