SECTION 1001.01 STATE BUILDING CODE ADOPTED:
The mandatory provisions of the Minnesota State Building Code, as adopted by the Commissioner of Labor and Industry pursuant to Minnesota Statutes Sections 326B.101 through 326B.16, including all of the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Labor and Industry, through the Building Codes and Standards Units, are hereby adopted by reference. The Minnesota State Building Code is hereby incorporated in this ordinance as if fully set out herein.

SECTION 1001.02 OPTIONAL ENFORCEMENT PROVISIONS:
The following optional provisions are hereby adopted and incorporated without change as part of the building code for the City.
- Grading, IBC appendix chapter J, 2006 International Building Code.
SECTION 1001.03 ADMINISTRATION, LICENSES, PERMITS, FEES AND SURCHARGES:
Subd. 1. Application, Administration and Enforcement: The application, administration, and enforcement of the Minnesota State Building Code shall be in accordance with Minnesota Rule Chapter 1300. The Minnesota State Building Code shall be enforced within the incorporated limits of the City and within the exterritorial limits permitted by Minnesota Statutes §16B.62. The City Council shall appoint a Building Official who shall attend to all aspects of Minnesota State Building Code administration.
A copy of the State Building Code shall be kept available for public use in the office of the Building Inspector.
Subd. 2. Licensed Activities: Except as otherwise provided in this Code, it is unlawful for any person to perform any work subject to the provisions of the Building Code unless he is currently licensed to do so under the applicable provisions of the Minnesota State Building Code or other State Law.
Subd. 3. Permits, Inspections, and Fees: The issuance of permits and the collection of fees shall be as authorized in Minnesota Statutes 16B.62, subdivision 1.
Permit fees shall be assessed for work governed by the Minnesota State Building Code in accordance with the fee schedule contained within this Chapter.
Subd. 4. Surcharges: In addition to the permit fee required under Subdivision 3 above, the applicant for a building permit shall pay a surcharge to be remitted to the Minnesota Department of Administration as prescribed by Minnesota Statutes §16B.70.
SECTION 1001.12 VIOLATIONS AND PENALTIES:
It is unlawful for any person to perform work subject to the Building Code for which a permit is required without having obtained such permit and having paid the fees required. A violation of this chapter shall be a misdemeanor.
SECTION 1001.13 CERTIFICATE OF OCCUPANCY:
No building or structure of Groups A, E, I, H, B, R-3 or R, Division 1 occupancy shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the Building Official has issued a certificate of occupancy therefore. No certificate of occupancy, including a temporary certificate of occupancy, shall be issued by the Building Official until all the exterior parts of the structure or building, including but not limited to the roof, doors, siding, attached decks, outside stairs, and windows are completed. SECTION 1001.14 EXPIRATION OF BUILDING PERMITS:
Every permit issued by the Building Official under the provisions of this code shall expire by limitation and become null and void, if the building work authorized by such permit is not commenced within one hundred and eighty (180) days from the date of issuance of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one hundred eighty (180) days time. Before such work can be recommenced, a new permit shall be first obtained to do so, and the fee therefore shall be one-half the original fee which was charged before commencement of any portion of the work.
Exterior work authorized by a building permit issued in accordance with the state building code after March 1, 2011 must be completed within three hundred sixty-five (365) days from the date of issuance of the building permit or within the timeframe set by the building official at the time the permit was issued, whichever is greater. Exterior work authorized by a building permit issued in accordance with the state building code prior to March 1, 2011 must be completed by March 15, 2012. If exterior work authorized by a building permit is not completed within the allowed timeframe, the permit for such exterior work shall expire, and a new permit must be obtained for completion of the exterior work. Failure to complete all exterior work authorized by a building permit within the allowed timeframe is a violation of this section. Exterior work includes work on all exterior parts of the structure or building, including but not limited to roofs, doors, siding, attached decks, stairs, and windows.
Upon a showing to the Building Official that there have been unavoidable delays in completion of the exterior work, the Building Official, in the Official’s reasonable discretion, may grant an extension of time for the completion of the exterior work for a period not to exceed six (6) additional months.
